GENERAL

All orders are conditional upon the purchaser’s agreement to the terms and conditions in this document.
These terms and conditions supersede any prior agreements or correspondence between the purchaser and Fiona Lynch Office.
Fiona Lynch Office reserves the right to change the terms and conditions of sale without notice.

DESIGN & SPECIFICATION

Non-standard features or finishes may incur surcharges.
All non-standard specifications must be expressly detailed when placing an order and may incur additional charges or increase lead time.
The client must ensure the size of the ordered product is appropriate to their need.
Clear access must be provided to the site for all deliveries.
Fiona Lynch Office is not responsible for inadequate calculations of architectural features including rooms, doorways, elevators and stairs.
All drawings, dimensions, samples, descriptive matter and specifications are intended as a guide only.
Fiona Lynch Office reserves the right to change, alter or modify the design, dimensions, or construction of any item without prior written notice.

ORDER CONFIRMATION

Confirmation will be forwarded to you in acknowledgement of your order.
Production begins soon after orders are placed and any changes to design or
specifications may not be possible after confirmation of your order has been sent.

LEAD TIMES

We will provide you with an estimated delivery time upon confirmation of your order.
Lead times are an estimate and commence upon receipt of deposit payment.
Whilst we will make every effort to achieve nominated delivery dates, delays do not constitute a breach of contract and Fiona Lynch Office is in no way liable for any resulting damages.
Lead times vary on orders.
Custom order lead times will be discussed in advance and provided with your quotation.
If there is a problem fulfilling your order within the designated lead time, we will endeavour to contact you within this period.

MATERIAL VARIATION

Slight variation in shape and colour is part of the nature of handmade craft and may be apparent between batches: this will not be an acceptable reason to reject an item. Our products are made by hand and consequently may contain some natural variation in size, shape and colour.

PAYMENT

Full payment must be received for all projects and orders prior to the commencement of works.
At our discretion, we may accept a deposit to commence works. This deposit is non-refundable.
Balance due prior to dispatch. No goods will be dispatched before full payment has been received.
All goods remain the property of Fiona Lynch Office until payment is received in full.
Deposits and payments made via electronic transfer or cheque must reference the Fiona Lynch Office invoice number. Please forward proof of electronic deposits via email.
We accept payment by Mastercard, VISA, American Express and Bank Transfer.
A late payment fee of 2% calculated monthly shall be applied to any late invoice amount. A payment is deemed late 14 days after the request for the final payment is made.

LIMITATION OF LIABILITY

In no event will we be liable for special, incidental, consequential or exemplary damages arising out of this agreement or out of the use of the goods or for services provided by us, including, without limitation, damages or costs relating to the loss of profit, business, goodwill, property damage, or bodily injury, even if we are advised of the possibility of such damages, or for any similar claim against you by another party.
The above exclusion of incidental and consequential damages may not be enforceable under some applicable laws, so such exclusion may not apply to you. In no case shall our liability for money damages exceed the invoice amount paid by you.

FORCE MAJEURE

We will not be liable for any failure or delay in performance or delivery which might be due, in whole or in part, directly or indirectly, to any contingency, delay, failure, or cause of, any nature beyond our reasonable control.
Such causes include, without in any way limiting the generality of the foregoing, fire, explosion, earthquake, storm, flood or other weather, unavailability of necessary utilities or raw materials, strike, lockout, unavailability of components, activities of a combination of workmen or other labour difficulties, war, insurrection, riot, act of God or the public enemy, law, act, order, export control regulation, proclamation, decree, regulation, ordinance, or instructions of any government or other public authorities, or judgment or decree of a court of competent jurisdiction.

RETURNS

Please choose carefully as refunds are not provided for change of mind or incorrect selection.  We recommend you carefully preview any orders before proceeding with an order. If you make an error, please contact us sales@fionalynch.com.au
If damage has occurred in shipping all packaging must be retained by the receiver. Failure to do so may invalidate any claim.
